BrokerBee and HomeConcierge.Team
Effective date: [insert before publication]
These Terms govern your use of the home concierge platform, free consumer membership, home profile, service requests, offers, and rewards program operated by BrokerBee, a Cierri company based in Colorado, operating BrokerBee and HomeConcierge.Team (collectively, “BrokerBee,” “we,” “us,” or “our”). “You” means the individual accepting these Terms. Our contact details appear in Section 19.
By affirmatively accepting these Terms when creating an account or submitting a request, you enter into this agreement. You may review and save a copy before accepting. Our Privacy Notice at [insert live Privacy Notice URL] explains our personal data practices. Accepting these Terms does not, by itself, constitute consent to optional marketing texts, calls, or data uses that require separate consent.
1 Membership and eligibility
Membership and access to the concierge are free. You must be at least 18, able to enter a binding agreement, and authorized to request work at the property. A request may be submitted before account creation where available; an eligible membership account is required to earn and redeem points. A real estate agent or brokerage relationship is not required.
Keep your contact details, property information, and account credentials accurate and secure. Use one personal account unless we approve otherwise. You are responsible for activity you authorize and must promptly report unauthorized access. We may verify identity, property authority, offer eligibility, and transactions using proportionate information requests. Do not impersonate another person or claim a property without authority.
A free account does not authorize a paid subscription. Any future paid feature requires a separate disclosure and your affirmative agreement before charges begin.
2 What the concierge provides
We help consumers find independent service providers, communicate requests, coordinate appointments, maintain home information, and access participating offers and rewards. Availability depends on location, provider capacity, job type, and the specific offer. We may use human staff, automated systems, and AI-assisted tools to support these functions.
Unless a separate written agreement expressly identifies BrokerBee as the service provider, BrokerBee is not the contractor performing the work, a general contractor, property manager, insurer, home warranty provider, or guarantor of a provider’s work. We do not pay for home repairs or other work except for a specific reward or promotional contribution we expressly agree to provide. Membership is not insurance or a repair warranty.
This is not an emergency service. For fire, gas leaks, immediate danger, or other emergencies, contact emergency services or the appropriate utility. Do not rely on messages, automated advice, or concierge availability for urgent safety decisions.
3 Providers bookings and payment
Your service contract is with the provider identified in your estimate or work agreement. You are responsible for approving the scope, price, permits, access arrangements, payment schedule, changes, cancellation terms, and warranties before work begins. A request or proposed appointment is not a confirmed booking until confirmed by the provider or the concierge on the provider’s behalf. We cannot approve extra work or charges for you without your authorization.
You pay the provider’s charges, taxes, materials, permits, and other disclosed costs, less any confirmed applicable discount. A pending reward does not excuse payment. Any payment collected through the platform is subject to the checkout disclosures and applicable processor terms. You retain applicable rights to dispute charges and defective or incomplete work.
Providers are independent businesses. Any screening or “vetted” description refers only to the checks actually described by us at the time; it is not a promise of continuous monitoring, current licensing or insurance, suitability for every job, or a particular result. Ask the provider for credentials and coverage appropriate to your work. We do not guarantee the lowest price, availability, completion date, workmanship, or safety of a provider.
We may receive subscriptions, advertising fees, placement fees, referral fees, or success fees from providers. Compensation may affect participation, presentation, or recommendations. We do not represent that our provider list includes every qualified local business or that it is an independent ranking. Provider compensation does not give members a right to any percentage of our fees or revenue.
4 Points and their value
“Points” means promotional loyalty units displayed as Concierge Coins, Concierge Credits, or points in your account. A naming change alone does not change your balance or value. Points are not money, deposits, cryptocurrency, securities, an investment, or a credit card product. They cannot be purchased, transferred, sold, pledged, or redeemed for cash, except where law requires otherwise.
The standard redemption rate is 100 points for $1 of eligible service credit. For example, 500 points can provide $5 of eligible service credit. A points balance is not a cash balance. Gift cards, merchandise, and other catalog rewards may require different point amounts disclosed before redemption. No particular catalog item is guaranteed to remain available.
5 Earning and posting points
The standard onboarding awards below apply once per eligible member, subject to verification and the rules shown with each action. Duplicate accounts, repeated uploads, canceled requests, and fabricated activity do not qualify. A home profile is complete when the fields identified as required for that award are accurately completed; optional sensitive information is not required.
Ongoing service, job-confirmation, seasonal, and engagement awards apply only when offered. The applicable award amount or calculation method, eligible action, limits, and deadline must be disclosed before participation. There is no universal earning rate per dollar spent and no automatic entitlement to a share of provider fees. Taxes, tips, refunds, canceled jobs, and ineligible charges do not earn points unless an offer says otherwise.
Job-based awards require a genuine eligible job requested and booked through the concierge, completed, paid, and verified. We may request confirmation or a receipt. Points may remain pending during verification or an applicable cancellation or refund period. Any additional posting period will be disclosed with the offer. Contact us about missing or incorrect points promptly; a reporting delay does not waive nonwaivable rights.
Any reward for feedback depends on an honest response, never a positive rating. You may report a problem and still provide qualifying feedback. Public incentivized reviews must disclose the incentive and follow the review platform’s rules. We do not require you to waive a complaint or remove a truthful review to receive an earned benefit.
6 Referral rewards
When the referral program is offered, an eligible member may earn 1,000 points when a genuinely new referred homeowner uses the member’s referral link or code and completes verified signup, and an additional 2,000 points when that person completes their first qualifying paid job. Attribution must be recorded at signup unless we correct a documented tracking error. Only one referring member may receive credit for the same new member.
Ongoing referral awards, if offered, are fixed point awards shown in the referral program before participation. They are not percentages of job prices or our revenue. Unpublished internal fee tiers do not create a consumer entitlement. Category amounts, eligibility, and any duration or cap must be stated in the live referral offer.
No self-referrals, duplicate or fictitious accounts, referrals between accounts controlled by the same person, misleading claims, unsolicited bulk messages, or unauthorized use of another person’s contact information. Clearly disclose that you may receive rewards when making a referral. Sharing a link does not give us permission to market to your contacts. The referred person must choose to participate. We may withhold or reverse rewards reasonably linked to abuse, subject to Section 10.
7 Welcome discounts and partner offers
The 500-point signup award is separate from any service discount. No $100 discount or free service is included unless it is expressly offered to you. Each offer must identify the eligible service, provider or availability limits, deadline, exclusions, and redemption steps before you accept it. “Free” applies only to the stated item or scope; optional upgrades and other work require a separate disclosed price and your approval.
If you receive the “25% off your first service, up to $100” welcome offer, it applies to eligible service charges on your first completed job requested and booked through BrokerBee, excluding taxes, tips, permits, and separately stated third-party fees. The job must be completed and the benefit claimed within 90 days of membership signup unless the offer provides more time. A $200 eligible service receives $50 off; a $400 eligible service receives $100 off.
That welcome discount is limited to one per property address, including the applicable unit number, ever, rather than one per person. A new occupant does not automatically reset eligibility. We will disclose known prior redemption that makes the address ineligible before booking under the offer. It cannot be combined with other BrokerBee discounts or promotions unless expressly permitted. Member confirmation of completion and honest vendor feedback are required; no favorable rating is required. The confirmed discount is applied to the invoice and is never paid as cash or a gift card. Provider-caused delays may be reviewed for an extension.
We and the provider must confirm eligibility and application of any discount before you approve the job. Do not assume a promotion applies to an independently booked service. An accepted offer’s disclosed terms govern that offer; we will not add undisclosed material restrictions after acceptance.
8 Redeeming points
Redeem available points through the member portal or concierge for then-available eligible service credits, gift cards, merchandise, or other published rewards. We will disclose the point cost, any minimum balance, delivery charges, restrictions, and any remaining amount you must pay before redemption. A service credit requires a participating provider and confirmation before payment; it does not automatically reimburse earlier work.
Points cannot be applied beyond the eligible charge, and unused service credit is handled under the disclosed reward terms. Gift cards are governed by the issuer’s separate terms and applicable law; expiration of program points does not itself expire an issued gift card. Once a reward is issued, a change-of-mind return is available only if the offer allows it. Statutory refund rights remain unaffected. If we cannot fulfill an accepted redemption, we will restore the points or offer an equivalent alternative you accept.
Any sweepstakes or prize drawing requires separate official rules, including eligibility, entry methods, deadlines, and a free alternative method of entry where required. These Terms do not establish or authorize a points-for-entry drawing. No member should spend or surrender points for a drawing unless its separate lawful rules expressly allow it.
9 Expiration and program changes
Points expire 12 months after their issuance date unless an offer gives a longer period or applicable law prohibits expiration. Each award has its own expiration date; new activity does not reset older awards. Redemptions use the earliest-expiring eligible points first. Your account will show applicable expiration dates. Pending points receive an issuance date when credited as available points.
We may change future earning opportunities, the catalog, eligibility rules, or the program. We will give at least 30 days’ advance notice by account notice or email of a material reduction in redemption value or other materially adverse change. A change will not retroactively remove a valid award already earned. Before a reduction affects existing balances, members will have at least 90 days to redeem those balances at the prior service-credit rate, without shortening that opportunity through ordinary expiration.
If we discontinue the program, we will provide at least 90 days’ notice and a reasonable way to redeem valid existing points during that period. We may act sooner to comply with law or address fraud or security threats, but only as reasonably necessary and subject to applicable law. No fixed future reward level or lifetime program availability is promised.
10 Refunds corrections and account closure
We may correct duplicate or mistaken credits and reverse points attributable to refunded, charged-back, canceled, unpaid, or fraudulent transactions. Any adjustment must reasonably correspond to the affected activity. If previously redeemed points are reversed, a points balance may become negative and future earnings may offset it; a negative points balance alone is not a cash debt. We may separately pursue lawful remedies for actual fraud.
We may suspend activity or close an account for material breach, fraud, unauthorized access, or safety concerns. Where practicable, we will explain the reason and provide an opportunity to contest a disputed adjustment or correct a remediable issue. Fraud-related forfeiture is limited to affected rewards unless broader forfeiture is reasonably justified by systematic abuse and permitted by law.
You may close your account through [insert account closure method] or by contacting us. Before voluntary closure, you may redeem valid points under the ordinary program rules; unused points are forfeited on closure to the extent permitted by law. For our closure without member fault, we will provide at least 30 days to redeem valid points. Closing an account does not cancel existing provider contracts, erase amounts lawfully owed, or require retention of personal data beyond lawful purposes.
11 Home information and your permissions
“Home Data” includes property addresses and characteristics, appliance details, photos, inspection reports, maintenance and repair history, improvements, invoices, preferences, requests, and other information you submit or authorize us to obtain. We may combine it with provider confirmations and lawfully obtained public or licensed property information for the purposes described here and in the Privacy Notice.
You retain any intellectual property rights you have in your original uploads. You grant BrokerBee a nonexclusive, worldwide, royalty-free license to host, store, reproduce, organize, extract facts from, adapt for formatting, and use those materials to operate your home profile, coordinate requested services, administer rewards, provide relevant maintenance information and offers subject to your choices, prevent fraud, and improve the platform. We may allow contracted service providers to exercise these rights only as needed for those purposes and may transfer the license with a lawful business transfer subject to continuing privacy obligations.
This license continues only while reasonably needed for those purposes and any lawful retention period described in the Privacy Notice. It is subject to applicable deletion, withdrawal, and other privacy rights. It does not permit unrelated public display of private home photos or reports, unrestricted resale of personal data, or general-purpose third-party AI model training without a separately disclosed lawful basis and any required consent.
Submit only information you own or are authorized to share and license for these uses. Owning a home does not necessarily give you copyright in an inspection report, professional photograph, or floor plan. Redact information you do not have permission to provide. Do not upload government identification numbers, payment credentials, medical information, security codes, or other unnecessary sensitive information. We may reject or remove material that infringes rights, creates security risks, or violates these Terms.
12 BrokerBee ownership and permitted data use
As between you and BrokerBee, BrokerBee owns its platform, software, trademarks, database structure, proprietary selection and arrangement of information, independently created service and transaction records, and original analytics and derived outputs, to the extent protectable by law. These ownership rights exclude your preexisting content and third-party rights. They do not create exclusive ownership of raw facts, your home, or your personal data, and do not override privacy rights in records or inferences about you.
BrokerBee may create and use aggregated or deidentified information for service improvement, analytics, business planning, and commercial reporting, including licensing such information, provided it meets applicable legal standards and is not reasonably linkable to a person or household. Removing a name alone is not sufficient. We will maintain required safeguards, will not attempt reidentification except for legally permitted testing, and will impose required restrictions on recipients.
Information reasonably linkable to you, your household, or your address may remain personal data even when stored in a property record or derived by us. Sale, targeted advertising, or another secondary use of personal data requires the notices, choices, and any separate consent required by law. Membership, points, and acceptance of these Terms are not blanket consent to such processing.
You receive a limited personal right to use the platform during authorized access. Do not scrape or resell nonpublic platform data, bypass access controls, interfere with operations, or misuse another member’s records. These restrictions do not prevent lawful access to or portability of your own information.
13 Privacy retention and property transfers
Our separate Privacy Notice must describe the categories and sources of information collected, purposes, recipients, retention criteria, applicable rights, and ways to exercise them. We share information reasonably needed with providers handling your requested work and with vendors operating our services. A provider may independently maintain its own service records and privacy obligations. Marketing access to home records is not automatically granted to every provider in the network.
We retain personal data only as reasonably necessary for disclosed purposes, lawful recordkeeping, fraud prevention, or legal claims, subject to applicable law. Account closure does not guarantee immediate removal from all backups or records, but ownership language does not allow indefinite retention without a lawful purpose. Applicable access, correction, deletion, portability, opt-out, consent withdrawal, and appeal rights remain available through the Privacy Notice and contact methods in Section 19.
You may participate in the basic program without optional marketing consent or optional sensitive-data uploads. Withdrawing marketing consent does not forfeit earned points. If a requested deletion makes a particular data-dependent feature or future reward impossible, we will explain that specific consequence; we will not impose an unrelated penalty for exercising privacy rights.
If you sell, move from, or cease to manage a property, update your account and access permissions. Points do not automatically transfer with the property. A new occupant does not automatically receive your private photos, reports, contact details, or identifiable service history. Any transfer of a home record requires appropriate authority, privacy protections, and removal or lawful disclosure of personal information.
14 Communications and consent
We may send communications reasonably related to your requested services, account security, transactions, and program administration through contact methods you provide, subject to applicable law and your channel choices. Providing a number does not grant unlimited permission to call or text. Automated service messages require applicable consent. Call recording, where used, requires legally sufficient notice and consent.
Promotional emails, texts, and calls are separate from acceptance of these Terms. We will obtain any legally required consent through a clear separate choice identifying the sender and communication method. Consent to automated marketing texts or calls is not a condition of membership or purchase. Provider-specific marketing permission must be separately obtained where required; our terms do not authorize every partner to contact you.
You may unsubscribe from promotional emails using their unsubscribe link, reply STOP to marketing texts, or use another reasonable revocation method. Message and data rates may apply, and frequency varies as disclosed at enrollment. Opt-outs will be honored within legally required periods. A marketing opt-out does not automatically prevent necessary nonmarketing communications through a permitted channel.
15 Information and technology limitations
Home profiles, maintenance reminders, estimates, and AI-assisted suggestions may be incomplete or inaccurate. They are general assistance, not an inspection, appraisal, engineering opinion, legal advice, or guarantee of home value or condition. Confirm material facts and safety-sensitive recommendations with a qualified professional. Uploaded home improvements do not guarantee an equity increase.
To the extent permitted by law, the platform and informational features are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not promise uninterrupted access or error-free outputs. This does not disclaim express promises we make, responsibility that cannot lawfully be excluded, or statutory consumer guarantees.
16 Responsibility and liability limits
To the fullest extent permitted by law, BrokerBee is not liable for an independent provider’s acts, omissions, property damage, workmanship, pricing disputes, or failure to perform solely because we introduced the provider or helped coordinate a booking. This does not excuse BrokerBee’s own actionable conduct or any duty that law places on us.
To the fullest extent permitted by law, neither party is liable under these Terms for indirect, special, incidental, consequential, exemplary, or punitive damages. BrokerBee’s aggregate liability arising from the platform or program is limited to the greater of $500 or the fees you paid directly to BrokerBee for platform services in the 12 months before the event giving rise to the claim. Amounts paid to independent providers are not platform fees.
These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence, liability for death or personal injury caused by negligence where it cannot be limited, nonwaivable privacy or consumer rights, or other liability that law prohibits limiting. They do not eliminate an expressly owed refund, restoration of improperly removed points, or fulfillment of an accepted redemption. Some jurisdictions do not allow certain exclusions or limits; only lawful limits apply to you.
To the extent permitted by law, you will reimburse BrokerBee for reasonable losses and defense costs from a third-party claim directly caused by your fraudulent conduct, willful unlawful misuse, or submission of content that you had no right to provide. This obligation does not cover BrokerBee’s own fault. We will promptly notify you, allow reasonable participation in the defense, and obtain your consent before a settlement imposes an admission or nonmonetary obligation on you.
17 Disputes and governing law
Contact us first so we can try to resolve a concern informally. This request does not restrict your ability to seek urgent relief, meet a filing deadline, use small claims court, contact a regulator, or exercise statutory rights. These Terms do not impose mandatory arbitration or a class-action waiver.
Colorado law governs these Terms, without applying conflict-of-law rules, except that mandatory protections of your state of residence remain applicable. Subject to nonwaivable venue rights and any available small claims forum, disputes may be brought in state or federal courts in Colorado with jurisdiction over the parties and claim.
18 Changes and general provisions
Material changes to these Terms will be communicated at least 30 days before taking effect, except where a shorter period is reasonably required by law or an urgent security issue. Changes apply prospectively, not to accrued claims or already accepted offer commitments. We will obtain renewed agreement or separate consent where required. Rewards changes also remain subject to Section 9.
These Terms and the specific offer terms you accept govern the relevant relationship. A specific offer controls its eligibility, value, and fulfillment details, but does not override statutory rights or authorize undisclosed data processing. If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce a provision is not a waiver.
We may assign this agreement in a merger, reorganization, or sale of the relevant business, provided existing obligations and applicable privacy protections continue. You may not transfer your membership without our approval. Provisions concerning outstanding obligations, lawful records and licenses, intellectual property, liability, and disputes survive closure only to the extent relevant and lawful.
